Official Rules

DATES OF PROMOTION: The “Boeing 2018 Military Appreciation Campaign” Promotion (the “Promotion”) begins at 2:00:00 p.m. Central Time (“CT”) on November 7, 2018 and ends at 11:59:59 p.m. CT on November 21, 2018 (the “Promotion Period”). All times in these Official Rules shall be United States Central Time. The Website (defined below) is the official time keeping device for this Promotion.

ELIGIBILITY: The Promotion is open to legal permanent U.S. residents residing in Illinois, Indiana, and Wisconsin, who are at least eighteen (18) years of age or older at the time of entry (the “Entrant”). Employees, officers, directors, partners, equity holders, members and agents, and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of (a) Boeing (“Sponsor”) and each of its respective franchisees, affiliates, contractors, consultants, legal counsel, public relations representatives, distributors, sales representatives and retailers, (b) FCBX (the independent creative agency) (c) Mozeus (the “Independent Administrator”), (d) National Sweepstakes Company, LLC, (e) Chicago Blackhawk Hockey Team, Inc. (“Chicago Blackhawks”), (f) the National Hockey League (the “NHL”) and its member teams, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., and/or NHL Interactive CyberEnterprises, LLC (the foregoing are collectively the “NHL Entities”), (g) United Service Organizations, or (h) any website providers, webmasters, advertising or promotional, fulfillment, or marketing agencies, and any others engaged in the development, production, execution or distribution of the Promotion (collectively referred to herein as “Promotion Entities”), are not eligible to participate in the Promotion. The Promotion is void outside of Illinois, Indiana, Wisconsin and wherever else restricted or prohibited by law. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor and Independent Administrator’s decisions, which are final and binding in all matters related to the Promotion.

HOW TO ENTER/PARTICIPATE: Entrant must visit www.BoeingSalutes.com/Blackhawks (“Website”) during the Promotion Period and customize a message of military appreciation on a digital hockey puck, complete and submit all required fields listed on the online entry form. Then, click “Submit” to receive one (1) entry into the Promotion. Entrant must customize a military appreciation message on a digital puck, complete the online entry form and click “Submit” to receive an entry into the Promotion.

There is a limit of one (1) entry per Entrant/email address per day. Entrants must enter separately each day to receive an entry into the Promotion.

Entrants entering the Promotion via a mobile device may be charged standard data rates according to the terms and conditions of the service agreement with his/her wireless carrier. Each wireless carrier’s rate plan may vary, and Entrants should contact their wireless carrier for information on data rate plans and charges relating to the participation and entry in the Promotion. Entrants are solely responsible for any such wireless charges.

Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, email addresses and/or any other methods, including, but not limited to, automated entry, disposable/temporary or forwarding email address will void that Entrant’s entry and that Entrant may be disqualified from the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered (“Authorized Account Holder”). The Authorized Account Holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential prize winners may be required to show proof of being the Authorized Account Holder. No mechanically or programmatically reproduced entries are permitted. Sponsor will not verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible, or incomplete entries.

WINNING/ODDS: On or about November 20, 2018, one (1) potential grand prize winner (the “Grand Prize Winner”) will be selected from among all eligible entries received during the Promotion Period in a random drawing conducted by National Sweepstakes Company, LLC whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. Odds of winning are dependent upon the total number of entries received during the Promotion Period.

PRIZE:

Grand Prize: One (1) Grand Prize Winner will be awarded; i) dinner with a Chicago Blackhawk Alumnus (identity of the alumnus to be determined by Chicago Blackhawks in its sole discretion), ii) four (4) 200 level tickets to a professional hockey game at the United Center on March 26, 2018 (location of the seats to be determined by Chicago Blackhawks in its sole discretion), iii) one (1) replica jersey, and iv) four (4) Blackhawk hats (the “Grand Prize”). Total ARV of the Grand Prize is $2,392.

Grand Prize Winner must be able to attend the game on the date specified by the Sponsor in order to accept the Grand Prize in its entirety. If the Grand Prize Winner is unable to attend the game on the date specified, then he/she forfeits his/her right to the Grand Prize and no compensation will be awarded. Grand Prize Winner is solely responsible for all costs, expenses, and incidentals associated with Grand Prize acceptance and use, including, but not limited to, additional ground transportation, parking, meals, beverages, gratuities, phone calls, insurance, taxes, travel to and from the United Center and/or any other other prize venue, and any other expenses not specifically mentioned as being included.  The Grand Prize is taxable as income and the Grand Prize Winner is solely responsible for any and all federal, state and local taxes arising from receipt, possession, acceptance or use of the Grand Prize. Only one (1) Grand Prize will be awarded. The Grand Prize will be awarded, time permitting.

Total ARV of all prizes to be awarded is up to $2,972.00.

PRIZE RESTRICTIONS: No transfer, substitution or cash redemption of Grand Prize, except at Sponsor’s sole discretion. No responsibility is assumed by the Sponsor for any cancellation or rescheduling of any Grand Prize related event in whole or in part. In the event of cancellation or rescheduling no alternate or substitute prize for such cancellation or rescheduling will be awarded. Sponsor reserves the right to substitute the Grand Prize with a prize of comparable or greater value. Sponsor will not replace any lost or stolen prize. Grand Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. Grand Prize Winner is solely responsible for any taxes on the prize, including, but not limited to all applicable federal, state and local taxes. Any difference between the stated ARV and the actual value will not be awarded. Grand Prize Winner agrees that the Grand Prize is being provided “as is”, and the Promotion Entities make no warranty, representation or guarantee regarding the Grand Prize, including but not limited to their quality, condition, merchantability or fitness for a particular purpose. All Grand Prize details not specified herein shall be determined by Sponsor and/or Chicago Blackhawks, in their sole discretion.

GRAND PRIZE CLAIM: Except where prohibited, potential Grand Prize Winner will be notified on or about November 21, 2018 via the email address or any other form of contact source provided at the time of registration (the “Notification”). Potential Grand Prize Winner will be required to complete and return an affidavit of eligibility, liability/publicity release and W-9 form (collectively the “Paperwork”) within the date and time indicated in the Notification. Potential Grand Prize Winner must return the Paperwork within the date and time indicated in the Notification. If the potential Grand Prize Winner fails to return the Paperwork within the date and time in the Notification, or is found to be ineligible, or if he/she does not comply with the Official Rules, such potential Grand Prize Winner and his/her entry will be disqualified and another potential Grand Prize Winner will be selected from the remaining eligible entries received during the Promotion Period. If the Notification is returned as undeliverable, this will result in disqualification and an alternate Grand Prize Winner will be selected. The value associated with the Grand Prize is taxable as income and the Grand Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the respective Grand Prize. The Sponsor, or a third party acting on its behalf, must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that the potential Grand Prize Winner does not have a unique, personal, and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of his/her Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner will be selected from among the remaining non-winning eligible entries received during the Promotion Period. Valid social security numbers will be determined by IRS requirements.

GENERAL CONDITIONS:  By participating in this Promotion, Entrants agree to be bound by these Official Rules and the decisions of the Promotion Entities, which are final in all respects and not subject to appeal. Sponsor reserves the right to disqualify permanently from this Promotion any Entrant it believes has violated these Official Rules and verify eligibility of Entrants. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any Entrant regarding this Promotion, except as expressly set forth in these Official Rules. By entering, each Entrant agrees to release, hold harmless and indemnify the Promotion Entities, the United Center Joint Venture, Blackhawk Community Ice Rink, LLC, and each of their respective parents, subsidiaries, affiliates, directors, officers, partners, equity holders, shareholders, members, employees, agents and representatives and all others associated with the manufacture, distribution, development and execution of this Promotion and prizes (the “Released Parties”) from and against any and all claims, liability, injury, expenses (including reasonable attorneys’ fees), damage, loss or causes of action (however named or described) that may occur, directly or indirectly, in whole or in part, from: (i) Entrant’s participation in the Promotion; (ii) the delivery, misdelivery, receipt, acceptance, possession, use or misuse of the prizes awarded in the Promotion; (iii) the use of the Grand Prize Winner’s name, photograph and/or likeness as permitted herein, including, without limitation, claims based on publicity rights, defamation and/or invasion of privacy; and/or (iv) any travel or activity related to the receipt, use or misuse of the Grand Prize, including, but not limited to, personal injury, death and/or property damage. Additionally, the Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant’s e-mail account to receive e-mail messages. Failure to comply with these Official Rules may result in disqualification from the Promotion. All Promotion materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Promotion materials submitted to Sponsor. In the event any portion of this Promotion is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Promotion or this Promotion, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Promotion. Sponsor may prohibit an Entrant from participating in the Promotion or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Promotion by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Promotion Entities. If for any reason this Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and randomly draw from those entries received up to the cancellation/suspension date to award the Grand Prize. CAUTION: ANY ATTEMPT BY A PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

PUBLICITY: Winning the Grand Prize constitutes permission for Sponsor and its agencies to use Grand Prize Winner’s name, address (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Promotion only, without further compensation, unless prohibited by law.

LIMITATIONS OF LIABILITY:  The Released Parties are not responsible for: (a); unauthorized human intervention in any part of the entry process or the Promotion; (b) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (c) any property loss, damage, personal injury or death, in connection with the prizes provided pursuant to this Promotion and/or any person’s participation in the Promotion; (d) any printing or typographical errors in any Promotion-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (as applicable); (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (including Entrant’s particular wireless device carrier network), hardware or software; (g) Entrant’s inability to connect to his/her particular mobile device carrier network for any reason, including due to poor carrier reception and/or signal strength at any particular location; and (h) any data fees Entrant may be charged by a wireless carrier for accessing the Website over its network.

DISPUTES: By entering the Promotion, Entrant agrees that any and all disputes which cannot be resolved between the Entrant and the Sponsor or Released Parties, and causes of action arising out of or connected with the Promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a state or federal court located in Cook County, Illinois, which Court shall apply the laws of the State of Illinois, without regards to any conflict of law principles. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrants actual out-of-pocket expenses, and Entrant further waives any right to have damages multiplied or otherwise increased. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

PRIVACY POLICY: Information submitted in connection with this Promotion shall be in accordance with the Sponsor’s Privacy Policy available at https://www.fcbchi.com/privacy-policy.html.

WINNER’S LIST: For the name of the Grand Prize Winner receiving a prize of more than $25, please submit a self-addressed, stamped envelope for receipt no later than December 27, 2018 to “Boeing 2018 Military Appreciation Campaign” Blackhawks, PO Box 10505, Rochester, NY 14610.
